I, [Your Printed Name] ___________________________________________________, enter into this waiver and release with the Federal Reserve Bank of Chicago (the “Bank”), as provided below.  In order to allow the Bank to exercise the rights granted to it by this form, I represent and warrant to the Bank that: (a) on the date the Video is entered into the Video Contest I am age 18 or over; and, (b) I have full power to enter into this waiver and release, to grant the rights granted herein, and to make the representations and warranties set forth herein.

[Your Child’s Printed Name] _____________________________________________________, a minor child, and I consent to my child’s appearance in a video entered in the Video Contest.  In consideration of my child being permitted to participate, I enter into this waiver and release with the Federal Reserve Bank of Chicago (the “Bank”), as provided below.  In order to allow the Bank to exercise the rights granted to it by this form, I represent and warrant to the Bank that: (a) my child is between 14 and 17 years of age on the date the Video is entered into the Video Contest; (b) neither I nor my child will revoke or disaffirm this waiver and release during the child’s minority; and, (c) I have full power to enter into this waiver and release, to grant the rights granted herein both with respect to myself and with respect to my child, and to make the representations and warranties set forth herein.

In consideration of [my]/[my child’s] participation in the Video Contest, I grant and release to the Bank a non-exclusive license to the video created for and entered in the Video Contest (the “Video”); to edit the Video in the Bank’s discretion; to create derivative works from the Video and to display, exhibit, duplicate, perform, distribute, and otherwise use the Video (all or any portion thereof) in any format now known or subsequently developed, in its original or edited form in any media for any and all educational or commercial purposes.  Also, the Bank may use and license others to use [my]/[my child’s] name, image, likeness, voice, and biographical or other information in connection with using the Video.  I further acknowledge that I [and my child] will not be compensated for any uses made of the Video.  I understand that use of the Video may include, but not necessarily be limited to, the following:  internal use at the Bank, including streaming on the Bank’s network; public distribution through various means, which may include satellite broadcast, cable TV, webcast, on-demand, physical media, or social media; or, educational, commercial or promotional use.

I understand that the Bank may post the Video to social media sites or similar public display platforms where the Video can be viewed, downloaded, duplicated, or otherwise used by any person.  I acknowledge that the Bank has no control over subsequent uses that any person may make of the Video once released to the public. 

I waive any rights that I may have to inspect or approve the Bank’s use of the Video, or to inspect or approve any editorial content that the Bank may use in connection with its use of the Video.  I release and discharge the Bank from any and all claims arising out of its use of the Video, including but not limited to any claims for libel, infringement of rights of publicity, or for invasion of privacy.  I represent and warrant that the Bank’s exercise of the rights granted in this waiver and release form will not violate or infringe on the intellectual, personal, or property rights of any person.  If I breach the representations I am making here, and if the Bank should suffer damages as a result, I agree to reimburse the Bank for those damages.

I have read and understood the contents of this waiver and release in its entirety, and I will indemnify, hold harmless and reimburse the Bank for any claim, suit, damage, loss or expense arising out of any breach of the warranties and representations I have made herein.
